Only information reasonably necessary for the relevant purpose should be collected and used.

3. Information obtained from public or third-party sources

Some professional contact information may be obtained from publicly available or legitimate third-party sources.

For example, professional names, job titles, organisational details, work email addresses, work telephone numbers or institutional postal addresses may be obtained from school websites, photography-club websites, company websites, venue websites, professional directories or similar publicly available sources.

Such information may be used for relevant business-to-business communication concerning photography talks, school visits, educational presentations, photography services, exhibitions, events or other services reasonably connected with the recipient’s professional role.

Where legitimate interests are relied upon, consideration is given to whether the communication is relevant, proportionate and reasonably expected. Requests not to receive further direct marketing will be respected.

Eduard F. Niga Photography does not purchase indiscriminate consumer marketing lists.

Information may also be supplied by another person, such as a family member making a booking, a school representative arranging a visit, or an organisation making an enquiry on behalf of a group.

5. Why personal information is used

Personal information may be used to:

  • Respond to enquiries.
  • Provide quotations and availability information.
  • Arrange and confirm bookings.
  • Enter into and perform contracts.
  • Provide photography sessions and commissioned photography services.
  • Deliver photography lessons and learning programmes.

  • Publish authorised testimonials or photographs.
  • Deal with complaints, disputes and data-protection requests.
  • Establish, exercise or defend legal rights.

Personal information will not be used for a materially incompatible purpose unless that processing is permitted by law.

6. Lawful bases for processing

UK data-protection law requires a lawful basis for processing personal information. Different lawful bases may apply to different activities.

Contract

Personal information may be processed where necessary to take steps at your request before entering into a contract or to perform a contract with you. This may include dealing with an enquiry, processing an order, arranging a photography session, booking a lesson or administering an expedition booking.

Legitimate interests

Personal information may be processed where necessary for legitimate business interests, provided those interests are not overridden by your rights and interests.

Examples may include responding to enquiries, maintaining appropriate customer and business records, securing the website, preventing fraud or misuse, managing customer relationships, protecting legal rights, maintaining appropriate photographic archives and carrying out proportionate business-to-business marketing where permitted.

Legal obligation

Information may be processed where necessary to comply with accounting, taxation, regulatory, court, law-enforcement or other legal obligations.

Consent

Consent may be relied upon where appropriate, including for certain marketing communications, non-essential cookies and advertising technologies, testimonials, promotional use of identifiable photographs and certain forms of sensitive information.

Where processing is based on consent, you may withdraw your consent at any time. Withdrawal does not affect processing that was lawful before consent was withdrawn.

7. Macro Photography Skills Assessment

The website may provide a Macro Photography Skills Assessment designed to identify development areas and recommend an appropriate learning pathway.

Information submitted may include your photography goals, equipment, experience, technical knowledge and answers to assessment questions.

The assessment may use automated rules to generate a photography-learning profile or recommend one or more teaching sessions.

Important: the assessment recommendation is advisory only. It does not make a legally significant decision about you, determine whether you are permitted to purchase a service or prevent you from choosing a different lesson option.

If you continue from the assessment into a booking process, relevant assessment information may be associated with your enquiry or booking so that you do not have to provide the same information repeatedly.

8. Photography and identifiable images

Photographs and video showing identifiable people may constitute personal data.

When you commission a photography session, photographs may be created and processed as reasonably necessary to provide the agreed service. This may include capture, selection, editing, retouching, storage, backup, gallery delivery, printing, reorders and customer support.

Commissioning a photography session does not automatically give unrestricted permission for the resulting photographs to be used for advertising or publicity.

Where identifiable client images are intended for portfolio, website, social-media, exhibition, editorial, advertising or promotional use, an appropriate lawful basis will be established. Depending on the circumstances, this may involve a separate image-use agreement, model release, consent or another lawful basis.

Permission for one type of use will not automatically be treated as permission for unrelated future uses.

9. Children

Bookings involving children should be made by an adult. Children are not expected to submit payment, booking or marketing information directly through this website.

When children appear in commissioned photographs, particular care is taken regarding privacy and public use. Promotional use of identifiable photographs of children will only take place where an appropriate lawful basis and any necessary parental or guardian permission have been obtained.

School-visit arrangements are normally made through adult members of school staff. Pupils are not normally asked to provide personal information directly to Eduard F. Niga Photography as part of a school presentation.

If photography or video involving identifiable pupils is separately planned, arrangements and responsibilities for obtaining appropriate permissions will be agreed with the school or organiser as appropriate.

10. Sensitive and special-category information

Eduard F. Niga Photography does not routinely request special-category personal information such as information relating to health, disability, religion or other particularly sensitive matters.

However, an individual may sometimes provide health, accessibility or similar information because it is genuinely relevant to participation in a photography session, event, lesson or expedition.

Please do not provide sensitive information unless it is reasonably necessary. Where special-category information needs to be processed, an appropriate lawful basis and an additional legal condition will be identified. Where appropriate, explicit consent may be requested.

Only the minimum information reasonably required for the relevant purpose should be retained.

11. Payments

Payments for products and services may be processed by third-party payment providers, including PayPal.

Payment providers process information required to complete transactions, prevent fraud and comply with their own legal and regulatory obligations.

Full payment-card numbers, card security codes and PayPal account credentials are not intended to be stored directly by eddimage.com.

Eduard F. Niga Photography may receive and retain information including:

  • Your name.
  • Billing or delivery details.
  • Payment status.
  • Transaction reference.
  • Amount paid.
  • Date of payment.
  • The product or service purchased.
  • Refund, chargeback or dispute information where relevant.

Payment providers such as PayPal may process personal information independently under their own privacy terms.

12. WhatsApp, Facebook and Instagram

Eduard F. Niga Photography uses services operated by Meta, including Facebook, Instagram and WhatsApp.

If you interact through one of these platforms, information may be processed both by Eduard F. Niga Photography for the purposes described in this policy and separately by the relevant Meta service under its own privacy terms.

WhatsApp

Where a website button prepares an enquiry for WhatsApp, information is not intentionally sent to Eduard F. Niga Photography until you choose to send the message through WhatsApp.

Facebook and Instagram enquiries

If you contact the business through Facebook or Instagram, information contained in your message, publicly available profile information and information reasonably required to respond to your enquiry may be processed.

Meta lead forms

If you submit a Facebook or Instagram lead form, information may include your name, email address, telephone number, location and answers to enquiry questions. The information will be used to respond to the specific enquiry or service in which you expressed an interest.

Submission of an enquiry does not automatically enrol you in unrelated marketing.

Meta advertising technologies

The website may use Meta advertising technologies, including the Meta Pixel, to measure advertising effectiveness and understand actions taken after an advertisement.

Where UK law requires consent before non-essential advertising or tracking technology is used, such technology should only operate after the required consent has been obtained.

13. Cookies and similar technologies

The website may use cookies, pixels, local storage, scripts, tags and similar technologies.

These technologies may be used for:

  • Essential website operation.
  • Website and account security.
  • Remembering user choices.
  • Payment functionality.
  • Website analytics.
  • Advertising measurement.
  • Other technical functions required to operate or improve the website.

Where consent is required for a non-essential technology, that technology should not be activated until an appropriate choice has been made.

A cookie-consent mechanism may provide more detailed information about technologies used by the website and allow you to manage your preferences.

You can also control cookies through your browser settings, although disabling essential technologies may affect website functionality.

14. Microsoft Teams and online lessons

Online photography lessons may be delivered using Microsoft Teams or another agreed online communication platform.

When you participate in a Teams meeting, Microsoft may process information associated with providing that service, such as your display name, email address or telephone number, meeting-participation information and technical usage information.

Microsoft processes information relating to Teams according to its own privacy arrangements.

Unless specifically agreed beforehand, photography lessons are not routinely recorded by Eduard F. Niga Photography.

15. Printing, fulfilment and delivery

Where you order physical photographic products, information necessary to complete the order may be shared with organisations involved in production, fulfilment or delivery.

These may include:

  • Professional photographic laboratories.
  • Framing providers.
  • Packaging or fulfilment providers.
  • Postal services.
  • Couriers and delivery companies.

Only information reasonably necessary to produce, administer and deliver the relevant order should be provided.

16. Photography expeditions and overseas services

When you enquire about or book an overseas photography expedition, personal information may be used to organise the trip and communicate with service providers involved in delivering the arrangements.

Where necessary, limited information may be shared with organisations such as:

  • Accommodation providers.
  • Local guides and spotters.
  • Transport providers.
  • Park, reserve or activity operators.
  • Other providers directly involved in delivering the trip.

Only information reasonably required for the relevant arrangement should be shared.

If personal information is transferred outside the United Kingdom, the international-transfer requirements described in this Privacy Policy apply.

17. Testimonials and reviews

Testimonials and reviews may be published on the website or in promotional materials where permission or another appropriate lawful basis exists.

Depending on what has been agreed, a testimonial may include a person’s name, location, organisation, professional role, photograph or comments about the service.

Permission to publish a testimonial will not automatically be treated as permission to use the individual’s information for unrelated purposes.

18. Direct marketing

Personal information will not automatically be added to a marketing list merely because you make an enquiry or purchase a product or service.

Email, text-message and similar electronic marketing will only be sent where permitted by applicable data-protection and electronic-marketing law.

Where marketing relies upon consent, you may withdraw that consent at any time.

Where marketing is carried out under another lawful basis, you may object to direct marketing at any time.

You have the right to object at any time to the use of your personal information for direct marketing.

If you opt out, a minimal suppression record may be retained so that your preference can continue to be respected and you are not accidentally contacted again.

19. Who personal information may be shared with

Personal information may be shared where reasonably necessary with:

  • Website hosting and technical-service providers.
  • Website security, backup and maintenance providers.
  • Email and communication providers.
  • Cloud-storage and file-transfer providers.
  • Microsoft in connection with Microsoft Teams.
  • PayPal and other payment-service providers.
  • Meta services where Facebook, Instagram, WhatsApp or advertising technologies are used.
  • Professional photographic laboratories and fulfilment providers.
  • Postal and courier services.
  • Travel, accommodation and local service providers involved in an expedition.
  • Accountants, insurers, solicitors or other professional advisers.
  • Government and taxation authorities where required.
  • Regulators.
  • Courts.
  • Law-enforcement bodies where disclosure is legally required or justified.

Eduard F. Niga Photography does not sell personal information to third parties.

20. International transfers

Some technology, payment, communication, advertising, cloud, travel or other service providers may process personal information outside the United Kingdom.

Where a transfer constitutes a restricted international transfer under UK data-protection law, an appropriate lawful mechanism or safeguard will be relied upon where required.

Depending on the recipient and circumstances, this may include UK adequacy regulations, an applicable UK-US data-transfer arrangement, the International Data Transfer Agreement, the UK Addendum to approved standard contractual clauses, Binding Corporate Rules or another mechanism permitted by law.

21. How long personal information is kept

Personal information is not intended to be kept indefinitely merely because it may be useful in the future.

Retention periods depend on why the information is held and on applicable legal, accounting, contractual, insurance and dispute-related requirements.

As a general policy:

  • General enquiries that do not become bookings:
normally retained for up to 12 months after the last meaningful contact.
  • Advertising and lead-form enquiries that do not become bookings:
normally retained for up to 12 months after the last meaningful contact.
  • Macro Photography Skills Assessment information:
reviewed periodically and removed when no longer required, unless connected with an ongoing customer relationship.
  • Customer booking, contract and significant correspondence records:
normally retained for up to six years following the relevant transaction or end of the customer relationship where reasonably required.
  • Accounting, payment and taxation records:
retained for the period required by applicable law and legitimate accounting requirements.
  • Order and delivery records:
normally retained with associated transaction records where necessary for accounting, legal or customer-service purposes.
  • Working photography files and delivered client photographs:
retained for delivery, backup, reorders, customer support and legitimate photographic archive purposes for only as long as reasonably justified, subject to periodic review.
  • Images lawfully selected for portfolio, publication or archival purposes:
may be retained for longer where an appropriate lawful basis continues to apply.
  • Marketing consent records:
retained while the consent remains relevant and for a reasonable period afterwards where necessary to demonstrate compliance.
  • Marketing objections and suppression records:
minimal information may be retained for as long as reasonably necessary to ensure that the person’s preference continues to be respected.

22. Security

Appropriate technical and organisational measures are used to protect personal information against accidental loss, unauthorised access, misuse, alteration, disclosure or destruction.

Measures may include secure website hosting, encrypted connections, software updates, access controls, password protection, backups and limiting access to information according to business need.

No website, email system, cloud platform or internet transmission can be guaranteed to be completely secure, and absolute security cannot therefore be promised.

23. Whether you are required to provide information

You are not normally under a statutory obligation to provide personal information simply by visiting this website.

However, certain information may be necessary if you want Eduard F. Niga Photography to answer a specific enquiry, provide a quotation, make a booking, provide a service, process an order, arrange an expedition, issue an invoice or comply with legal and accounting obligations.

If information necessary for a particular service is not provided, it may not be possible to provide that service or complete the transaction.

24. Your data-protection rights

Depending on the circumstances and the lawful basis being relied upon, you may have the right to:

  • Ask whether personal information about you is being processed.
